For anyone wanting marry in this Country - A 'Notice of Intended Marriage' form must be completed and lodged with me at least one month prior to the wedding. You cannot get married within Australia without giving one month’s notice. Once lodged with me, the Form 13 is valid for a maximum period of 18 months (See above for link to this form). The marriage cannot take place until one month after the date I receive the Notice of Intention to Marry form from you, unless a Prescribed Authority (Court Magistrate) has authorised the marriage to be solemnised before that time has elapsed. (see below for a shortening of time)
If a party to an intended marriage cannot conveniently sign this notice at the time, the other party may sign the notice and give to me (eg the Bride or Groom). However in this case, the party who has not signed the notice must sign it, in my presence, before the marriage can be solemnised.
Paperwork that must be provided
Along with giving me evidence of identification you must also provide proof of date and place of birth - this can be done by producing one of the following:
For anyone born within Australia:
- an original birth certificate, OR
- an original extract of birth OR
- certified copy of either of the above and an Australian Driver's Licence
- An Australian Passport is acceptable for this purpose
If you were born overseas:
- an original birth certificate, OR
- an original extract of birth OR
- a certified copy of either of the above
- An overseas passport
Certain documents need to be produced if either party has been previously married:-
If a party has been divorced - evidence of that party's divorce - I need to sight court evidence of the decree absolute upon dissolution of marriage. Evidence of divorce is needed before being married.
As of 1st July 2002, the Family Court and the Federal Magistrate’s Court ceased issuing both a decree nisi of dissolution of marriage and a decree absolute. They now issue a document titled "Certificate of Divorce", which contains the dates of the decree nisi and the decree absolute. This certificate is evidence of divorce for the purpose of solemnising a marriage.
If you were divorced prior to 1st July 2002 you will need to show me a copy of the decree absolute.
If a party is widowed - the death notice of that party's spouse.
Marriage of a minor
For a person under the marriageable age to marry it is a requirement for certain documents to be provided to the celebrant. A parent's consent and a court order under Section 12 of the marriage Act is required if one person to the marriage is under 18 years of age. Under no circumstances can two minors be legally married.
Shortening of Time process
There are reasons that allow you to apply for a shortening of time (less than one month). To apply for a shortening of time you must consider the reason to come within one of the following criteria:
Considerations by the Court are given for:
- Employment related or other travel commitments
- Wedding or celebration arrangements or religious considerations.
- Medical Reasons
- Legal proceedings
- Error in giving notice * (This relates only to error on the part of the celebrant)

Overseas Couples Wanting to Marry in Australia
Working with overseas couples for an Australian Wedding is easy. The same applies when one party to the marriage is overseas and the other person is here in Australia. There are just a few administrative details to adhere to, and then we work via Skype, phone and email. If you are able to make a visit to Australia prior to your wedding I can work with you to plan a meeting. The main paperwork that must be completed include:
- A 'Notice of Intended Marriage' (form 13) must be completed
- Original identification and Proof of date and place of birth documentation must be viewed (see below for details)
A Notice of Intended Marriage form must be completed and lodged with me at least one month prior to the wedding. This form can be obtained from the Government website: http://www.ag.gov.au/FamiliesAndMarriage/Marriage/Documents/NoticeofIntendedMarriageForm.pdf
Once lodged with me this form is valid for a maximum period of 18months. I usually ask couples to handle this as early as possible to ensure we have no last minute difficulties.
This form can be completed by you if you are overseas - then witnessed by the appropriate officer and mailed to me. If the bride or groom are in Australia - we can fill the Form in with just one person - then get the other party to complete it when they arrive in Australia. (the month starts from the time that one person has signed the form and I have witnessed their signature)
The Page 3 of the form must be completed carefully then taken to an appropriate officer to witness your signatures. An appropriate officer who can sign this form outside of Australia is one of the following:
- An Australian Diplomatic Officer
- An Australian Consular Officer
- A Notary Public - A person in any country publicly authorised to attest contracts and perform other formalities. Someone authorised to witness legal documents.
- An employee of the Commonwealth authorised under para 3(c) of the Consular Fees Act 1955
- An Employee of the Australian Trade Commission authorised under para 3 (d) of the Consular Fees Act 1955
The easiest of all of these is usually the Notary Public. Once this has been done the form should be forwarded to me via scanned attachment and email and then the documents sent by registered mail.
When you arrive in the country I can then view your original Identification.
Once the paperwork is finalized, we can then start working on your ceremony - I would then go through the same process with you as I do for couples that reside in Australia.Top
